The Services

MyEvaluationPal provides online credential evaluation tools and related services for educational institutions, applicants, and authorized users, as described on our website, application, or applicable order form or invoice.

Eligibility & Accounts

You must have authority to enter into these Terms on behalf of yourself or the entity you represent.

You are responsible for:

• Maintaining the confidentiality of account credentials
• All activity that occurs under your account
• Ensuring information you submit is accurate and lawful

License & Permitted Use

Subject to payment and compliance with these Terms, MyEvaluationPal grants you a non-exclusive, non-transferable, limited license to access and use the Services for internal, lawful purposes.

You may not:

• Reverse engineer, copy, or resell the Services
• Circumvent security or access controls
• Use the Services to submit unlawful or infringing content
• Interfere with system integrity or performance

Orders, Fees & Payment

Fees, quantities, and service details are specified in the applicable invoice, order form, or subscription plan.

Unless otherwise stated:

• Fees are non-refundable
• Purchased evaluation credits do not expire while access remains active
• Payment of an invoice constitutes acceptance of these Terms

Service Levels

MyEvaluationPal provides access to its Services through subscription plans. The level of service and applicable turnaround times depend on the subscription plan and the type of service being used.

Manual Calculator Subscription

Under a Manual Calculator subscription, subscribers receive access to the MyEvaluationPal calculator and related tools for conducting their own credential evaluations. The subscriber is responsible for entering and reviewing information and for determining the appropriate use of the calculator's results.

The Manual Calculator subscription does not include a MyEvaluationPal-operated evaluation service or a guaranteed evaluation turnaround time. Availability of the calculator and related subscription features is subject to the availability and maintenance of the Services.

AI-Assisted Evaluations

Where a subscription includes AI-assisted evaluation services, MyEvaluationPal will process submitted credentials using its AI-assisted evaluation tools and applicable review processes. MyEvaluationPal guarantees completion of AI-assisted evaluations within twenty-four (24) hours of submission.

The twenty-four (24) hour target applies only to AI-assisted evaluations submitted through a subscription that includes such services and does not apply to Manual Calculator subscriptions.

Turnaround times may be extended when additional information, document verification, clarification, third-party information, or other circumstances outside MyEvaluationPal's reasonable control are required. Where an AI-assisted evaluation is not completed within the applicable target timeframe for reasons attributable to MyEvaluationPal, MyEvaluationPal may, at its discretion, provide an additional evaluation credit for the affected evaluation.

Subscription Availability

Service levels and features are determined by the subscriber's applicable subscription plan, order form, or other applicable subscription terms. MyEvaluationPal may periodically update or modify its Services, provided that such changes do not materially reduce the core functionality of the subscriber's then-current subscription during its applicable subscription term.

Data Ownership & Privacy

Customers retain ownership of all data submitted through the Services.

MyEvaluationPal processes data solely to provide the Services and in accordance with the Privacy Policy available at: https://myevaluationpal.com/privacy

Where applicable, MyEvaluationPal acts as a school official under the Family Educational Rights and Privacy Act (FERPA) solely for purposes of performing the Services.

Intellectual Property

All rights, title, and interest in the Services, including software, designs, workflows, and documentation, remain the exclusive property of Byte Brain AI LLC.

No rights are granted except as expressly stated in these Terms.

Feedback

If you provide feedback, suggestions, or ideas regarding the Services, you grant MyEvaluationPal a perpetual, irrevocable, worldwide, royalty-free license to use, modify, incorporate, and otherwise exploit such feedback for any purpose, without obligation or compensation to you.

Confidentiality & Security

Each party agrees to protect the confidentiality of non-public information disclosed in connection with the Services.

MyEvaluationPal implements administrative, technical, and organizational safeguards designed to protect customer data, consistent with industry standards and SOC 2 principles.

Disclaimer of Warranties

The Services are provided "as is" and "as available."

To the maximum extent permitted by law, MyEvaluationPal disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law:

• MyEvaluationPal's total liability shall not exceed the fees paid by Customer under the applicable invoice or order
• We shall not be liable for indirect, incidental, special, or consequential damages

Force Majeure

MyEvaluationPal is not responsible for delays or failures caused by events beyond reasonable control, including natural disasters, network outages, or governmental actions.

Term & Termination

These Terms remain in effect while you access or use the Services.

Either party may terminate for a material breach not cured within thirty (30) days of written notice.

Upon termination:

• Access to the Services will be revoked
• Data handling will follow the Privacy Policy and retention obligations

Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles.

Changes to These Terms

We may update these Terms from time to time. Material changes will be posted at least 30 days before becoming effective.

Continued use of the Services constitutes acceptance of the updated Terms.
